Legal Issues for Johnny Depp

A recent article in The Divorce Project outlines the potential legal issues faced by recently split unmarried couple Johnny Depp and his long term girlfriend Vanessa Paradis. The couple has two children together, daughter Lily-Rose Melody Depp (born 1999) and son John “Jack” Christopher Depp III (born 2002).

There is currently no Common Law Marriage statute in California. If two people cohabitate in this state, they can only have oral or written claims against each other. But how do you prove

an oral contract? Without a witness or a written contract, it’s very difficult. Proof of such contract could be things like a history of payments over a period of time. So if a history of payments, a written contract or some other form of documentation isn’t available, many cohabitating partners that split are out of luck.

Child support and child custody can also be more complicated in these situations. It’s unclear what sort of assets, property, etc. Depp and Paradis shared, but we hope for the kids’ sake especially that it wasn’t a messy breakup.

Tom Cruise and Katie Holmes Settlement

Details about Tom Cruise’s settlement with Katie Holmes have emerged, reports TMZ. Holmes will get child support, but not spousal support, reportedly.

Cruise will pay Holmes a total of $4.8 million over the next 12 years, which is $400,000 per year in child support until Suri, 6, turns 18. Cruise will also pay for Suri’s health, dental and tuition costs. Furthermore, the settlement prevents Suri from attending a “residential school” of any sort. This prohibits her from going to a “Scientology school” that Cruise allegedly wanted Suri to attend.

Holmes apparently blindsided Cruise when she filed for divorce on June 29, but the couple reached a settlement just two weeks later.

The Humphries Family Divorces

Ironically, on Kim Kardashian and Kris Humphries’ one year “wedding anniversary” today, TMZ reported that Humphries’ parents, William and Debra, are going through their own divorce.

Debra Humphries reportedly filed for divorce early this month. The couple has three kids- Kris and his two older sisters, Krystal and Kaela.

Kris is fighting his divorce from Kim due to religious beliefs, but apparently his parents might not share the same sentiments.

Are Debra and William exchanging divorce tips and tricks with their basketball star son? Either way, at least the Humphries parents were married for longer than 72 days.

Evelyn Lozada Leaves Wide Receiver Chad Johnson Following Domestic Violence

Evelyn Lozada has filed for divorce from American wide receiver  Chad Johnson, formerly Chad Ochocinco, following a domestic dispute, reports People. The couple was only married 41 days.

Johnson was arrested Saturday night on a domestic violence charge. He allegedly headbutted his wife, and she was treated for a laceration at a nearby hospital. She filed for divorce Tuesday claiming her marriage is “irretrievably broken.”

“I would like to apologize to everyone for the recent events that have occurred. I would like to wish Evelyn well and will never say anything bad about her because I truly love her to death,” Johnson posted to his website Tuesday.

The couple was planing on starring in a reality show called Ev and Ocho, but that got the axe along with Johnson’s position on the Dolphins.

Professional Boxer Evander Holyfield Officially Finalizes Divorce

Evander Holyfield, an American professional boxer known as “The Real Deal”, has officially finalized his divorce, TMZ reported. His ex-wife, Candi Holyfield, originally filed for divorce two years ago!

In 2010, Candi ended the marriage and eventually attempted to obtain a protective order against the boxer, claiming he hit her several times. She later dropped that attempt, said TMZ.

That seems to be behind them now, as the couple has come to a settlement agreement on issues of child support, custody, alimony and property division.

It’s unclear who received what, but Evander’s $14 million mansion in Georgia was just foreclosed on earlier this year and Candi recently filed for Chapter 7 bankruptcy. So there may not have been much to divvy up.

WWE Superstar John Cena Settles Divorce

The drama between professional wrestler and WWE superstar John Cena and his wife, Elizabeth Huberdeau over their divorce is over, TMZ reported. But it wasn’t a clean break. Huberdeau believed her husband was messing around with other women and tried to challenge their prenup, reportedly.

She allegedly felt blindsided when Cena abruptly filed to end their three-year marriage back in May. However, her attorney, Raymond Rafool told TMZ the couple has managed to work things out privately.

Was the drama truly over or has the couple decided not to let the public in on their personal soap opera any longer? Who knows.

STEVIE WONDER FILES FOR DIVORCE

Stevie Wonder has been separated from wife Kai Millard Morris since October 2009, and TMZ reported this morning that he has filed divorce papers citing irreconcilable differences.

Morris is a fashion designer known for dressing Michelle Obama in 2009. She and Wonder have been married for 11 years and have two sons together.

Wonder filed using his legal name “Stevland Morris” and has asked for joint custody of the boys. This will be Wonder’s second divorce. He split from Motown songstress Syreeta Wright in 1972.

‘Baseball Wives’ Star Anna Benson Registers Children as Homeless Following Separation

Anna Benson, VH1’s “Baseball Wives” star and mother to Kris Benson’s three children, was served with divorce papers after she said she discovered evidence of an affair, Fox News recently reported.

Anna says that her husband Kris started an affair with one of her close friends as she was recovering from foot surgery early this year. And, she adds, this isn’t the first time he has cheated.  Benson claims she first was suspicious when she found “sexy messages” exchanged on Facebook between her husband and her close friend.

Now separated, Benson states that her husband tricked her into selling the family’s home in Georgia, and she and her children must vacate early August. Anna Benson reportedly signed a prenuptial agreement and receives $4,000 a month in child support. Due to their current situation, she has registered her children as “homeless” for the upcoming fall semester.

Kris Benson claims he is being “fair and reasonable”, yet Anna insists she is unable to provide an adequate home for her children under these circumstances.
